EAN Terms of Use for Web/App

Welcome to www.ebuyartisannetwork.com. These Terms of Use, our Privacy Policy, Mobile Devices Terms, and other posted policies outline the terms governing your access to and use of our site, services, applications, and tools (“Services”). By accessing or using our Services, you agree to comply with these terms, which include our policies and Privacy Policy.

Account Registration and Security

When creating an account, you’ll need to provide an email address and password. You’re responsible for keeping your password secure, preventing unauthorized access, and not sharing or transferring your account without our consent. Choose a strong, unique password to protect your account. If you connect to our Services through a third-party service, you grant us permission to access, store, and use your information from that service as described in our Privacy Policy and permitted by the service. If you suspect your account has been compromised or misused, contact EAN Customer Support immediately.

Using the Services- You will post in the appropriate category or area and will not engage in any prohibited activities:

violate any laws or our Prohibited Content Policy;
be false or misleading.
infringe any third-party right.
distribute or contain spam, chain letters, or pyramid schemes.
distribute viruses or any other technologies that may harm EAN or the interests or property of EAN users.
impose an unreasonable load on our infrastructure or interfere with the proper working of the EAN.
copy, modify, or distribute any other person’s content.
use any robot, spider, scraper or other automated means to access EAN and collect content for any purpose without our express written permission.
harvest or otherwise collect information about others, including email addresses, without their consent.
bypass measures used to prevent or restrict access to EAN.

Abusing EAN Services. If you encounter any problems or offensive content, please use the flagging system to report it to us. We’ll take action to maintain a safe and functional site. If a user violates our policies, we may limit or terminate their access, remove content, and take technical and legal measures. However, we aren’t liable for monitoring content or user actions, or for any unauthorized or unlawful use of our Services.

Global Marketplace. When using our Services, some features may display your ads on our partner sites in other countries. By using the Services, you consent to having your ads displayed on these sites, which are subject to similar terms and potentially additional local laws and restrictions. You’re responsible for ensuring your ads comply with the policies of each site. We reserve the right to remove your ad if it’s flagged or violates any laws or policies on any of our sites.

Fees and Services. Using our Services is generally free, but some features may require a fee. If a fee is charged, you’ll review and accept it before proceeding. Our fees are in Nigerian Naira and are subject to change. We’ll post changes to our fee policy on the site, and promotional or new service fees may be temporary. All fees are non-refundable and due on payment. If you fail to pay, we may limit your access to the Services or collect fees owed through other means.

Our Services are available on EAN websites and mobile apps, but some features may differ depending on the platform or device. To use our EAN Digital Retailing Solution, you’ll need to meet certain eligibility criteria, including residency in Nigeria and meeting age requirements. You’re responsible for complying with laws and regulations when purchasing from sellers through EAN, including any necessary licenses or insurance.

Content. Our Services include content from us, you, and other users, as well as third-party providers. By using the Services, you agree not to copy, modify, resell, or distribute our content, copyrights, or trademarks. When you provide content, you grant us a non-exclusive, worldwide, perpetual license to use, reproduce, and distribute it. If you believe your rights have been violated, please contact EAN Customer Support. We reserve the right to remove content that may infringe on these terms or the rights of others.

Reporting Intellectual Property Infringements (Verified Rights Owners – VeRO). You agree not to post content that infringes on third-party rights, including intellectual property and likeness rights without consent, and understand that we may remove such content and have a process for reporting infringement through our VeRO Program.

Disclaimers and Limitations of Liability. The Services are provided “as is” and “as available”. You agree not to hold us responsible for things other users post or do. You also agree not to hold us responsible for the payment processing of other service providers such “Third Party Payment Processor”. For greater certainty, as applicable, if you link a Third Party Payment Processor account to your EAN Account, you acknowledge and agree that by making payments through EAN with that Third Party Payment Processor, you are bound by that Third Party Payment Processor’s applicable terms and conditions, and we are not liable for any loss, claims or damages howsoever arising in connection with that third party’s services). As most of the stuff on the Services comes from other users, we do not guarantee the accuracy, completeness, efficacy or timeliness of any postings or user communications or the quality, safety, or legality of what is offered. We also cannot guarantee continuous or secure access to our Services. Notification functionality in our Services may not occur in real time. Such functionality is subject to delays beyond our control, including without limitation, delays or latency due to your physical location or your wireless data service provider’s network. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of EAN, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

Indemnification. You agree to indemnify and hold harmless EAN and its affiliates, officers, directors, agents, and employees from any third-party claims, losses, and costs arising from your use of the Services, alleged term violations, or breaches of applicable laws and regulations.

Personal Information. By using Services, you agree to the collection, transfer, storage and use of your personal information by EAN Nigeria.

Reviews. You may be asked to leave a review when messaging with other users on EAN. Reviews consist of a 1-5-star rating and selected reasons why you’ve chosen that review. Your submitted review, username, profile photo (if available), and the category of the seller’s listing will be made public. User reviews should be left in good faith, ensuring that both you and the other user are depicting your interaction fairly. When leaving a review on another user’s account, the review should:

be truthful to what happened between you and the other user
not be left to harass or abuse another user
not be in left to manipulate or mislead other users

To ensure the integrity of the review system, users are not able to edit or remove reviews on their own profile or someone else’s. EAN will also not mediate review-related disputes. User reviews reflect the opinions of individual EAN users and do not reflect the opinion of EAN. We reserve the right to remove reviews which violate our policies or guidelines.

General.

We may update these terms at any time, with changes taking effect upon your next site use or after 30 days. Any further amendments require a written agreement signed by both you and us. For questions, comments, or complaints, contact EAN Customer Support.
